The plaintiffs, former inmates of the Oneida County Correctional Facility, represented female inmates in general population custody and argued that the January 2020 transfer from pod housing to linear housing violated their rights under the Equal Protection Clauses of both the Fourteenth Amendment to the United States Constitution and the New York State Constitution, as compared to similarly situated male inmates who were not transferred and were under better housing conditions. The court recommended that the plaintiff class be certified as meeting the exhaustion requirements of the Prison Litigation Reform Act ("PLRA") under the circumstances presented.
