The Sixth Circuit denied the government's motion for a stay pending appeal of the district court's preliminary injunction, which had set forth a framework for evaluating releases on an individual basis and mandated a series of improvements to the conditions at Oakland County Jail in order to mitigate the spread of COVID-19. The court held that the district court's findings of fact were not clearly erroneous, noted that the district court had not ordered any releases at the time, and ultimately held that the district court had not abused its discretion. Judge Bush dissented.
A few weeks later, Judge Guy recused from the case and the government filed a renewed motion for a stay pending appeal. This time, the Sixth Circuit stayed the district court's preliminary injunction over a dissent.
