Two individuals in immigrant detention were denied TROs seeking release despite medical concerns including traumatic brain injury, diabetes, and hypertension. Though the court agreed that their conditions were serious and noted that there were significant flaws in the detention centers' measures to mitigate the virus, the court noted that neither detention center had confirmed cases of COVID-19 present and that the petitioners had criminal histories that weighed against release. However, the court denied the request without prejudice, indicating that the analysis would change if the detention centers had positive COVID-19 cases.
