The court transformed the TRO form April 9, 2020, into a preliminary injunction ordering the continued release of intervenor Mr. Toma. The court again rejected the respondent’s argument that the petitioners, Malam and Toma, had not shown deliberate indifference on the part of the jail. The court did not find persuasive respondent’s argument that if Mr. Toma must be released, it would be unconstitutional for ICE to hold anyone during the COVID-19 pandemic. While in granting the TRO the court relied on general information about Mr. Toma’s age and poor mobility, to justify converting the TRO into a preliminary injunction the court gave more in-depth consideration to the implications of Mr. Toma’s lack of physical mobility. It also considered medical records from Mr. Toma’s doctor outside the jail who had diagnosed him with COPD and referred him for a variety of medical services. Mr. Toma continued to show a likelihood of success on the merits of his Fifth Amendment deliberate indifference claim, warranting injunctive relief. The same release conditions remained in place.
