Despite the individual’s underlying conditions of hypertension and kidney disease and despite the fact that he satisfied the exhaustion requirement, the court found that he failed to establish extraordinary and compelling reasons for release since the prison has no positive cases of COVID-19 and had taken measures to prevent its spread. The individual was also deemed a flight risk due to his violation of the terms of his previous bond, which the court found outweighed the assertion that the individual’s reduced financial resources and government travel bans made it impossible for him to flee.
