The plaintiffs initially filed a complaint seeking habeas corpus and other relief for unconstitutional confinement and unconstitutional punishment in violation of the U.S. Constitution. The defendants filed a motion for a protective order seeking to enjoin the plaintiffs from taking Sheriff Barnes' deposition, but the court denied defendants' motion since it is clear that he was not only involved in setting COVID-19 related policies within the Orange County Jail, but he also has personal knowledge of how COVID-19 is impacting the Orange County Jail. The court denied the defendants' Motion For Protective Order and the defendants are to produce Sheriff Barnes for a time-limited deposition of no more than 3.5 hours of questioning by the plaintiffs' counsel.
