The court denied the motion for a temporary restraining order and preliminary injunction for a putative class of individuals, who have underlying medical conditions or are otherwise highly susceptible to harm from COVID-19, in four Oregon state institutions, finding that defendants had responded reasonably to the risks posed by COVID-19. While the court found that plaintiffs did not demonstrate that defendants acted with deliberate indifference, the court concluded that plaintiffs established the likelihood of irreparable harm as plaintiffs are at an increased risk of COVID-19 infection in prison, especially in light of their underlying medical conditions and age. However, the court decided that it “does not have the authority to order any relief that would directly or indirectly require ODC to reduce its prison population.”
