U.S. v. Pryor (E.D. Pa.) - Motion to Lift Warrant and Detainer Granted
Naim Pryor filed an emergency motion to lift warrant and detainer which were lodged against him by the court on January 6, 2020, as the result of his alleged violations of his supervised release. Pryor was on supervised release under the condition that he refrain from the illegal possession or use of drugs, when he was arrested for possessing drugs in his vehicle; this resulted in his detention in a county jail until he was brought to a revocation hearing at this court. The court granted Pryor’s motion to lift the warrant and detainer and ordered that Pryor remain free once he makes bail until the charges are decided in the state court or this court has held a revocation hearing on his supervised release. First, the court reasoned that the dangers of COVID-19 pandemic in light of his medical conditions (various lumbar spinal joint issues) and the spread of COVID-19 in his facilities support this decision. Moreover, the court considered the fact that Pryor had strong family ties to find that he did not pose a risk of flight, further supporting the decision to lift his warrant and detainer.
