U.S. v. Deutsch (2d Cir.) - Affirmed Grant of Pretrial Bail
The appeals court affirmed the district court’s grant of pretrial bail to Deutsch. The court reviewed the district court’s findings of Deutsch’s risk of flight and potential danger to the community and did not find clear error, which it defined as “the definite and firm conviction that a mistake has been committed.” Specifically, the court found that the district court held Deutsch to his limited burden of production to rebut the presumption of detention under § 3142(e)(3) of the Bail Reform Act and that it authorized release after reasonably concluding that the conditions of release reasonably assured the safety of the community and mitigated Deutsch’s flight risk.
